Driver not at fault in fatal collision with pedestrian, Grover Beach Police say

A two-and-a-half-month investigation into the death of a man struck and killed while walking in the road has concluded with the Grover Beach Police Department deciding that the driver was not at fault.

At 6:58 p.m. Jan. 21, the California Highway Patrol responded to the accident near North Oak Park Boulevard and Brighton Avenue in Grover Beach, according to a news release.

Justin Dean Truman Kissinger was wearing dark clothing and under the influence of alcohol by more than twice the legal limit when he was hit while trying to illegally cross North Oak Park, Grover Beach Police said.

Although first responders arrived quickly, Kissinger died at the scene, according to the release. He was 33 and an Arroyo Grande resident.

According to the release, Kissinger walked into the street in a diagonal direction and made it through the two southbound lanes. He narrowly missed being hit while in the first northbound lane, but was struck in the second northbound lane, the release said.

The driver’s name was not released.

Grover Beach police and the CHP concluded their investigation of the incident April 9 and after reviewing the evidence determined the driver was not at fault.
