Update: Man shot, killed by SLO County deputies is identified
A San Luis Obispo County sheriff’s deputy shot and killed a Chowchilla man in Los Osos on Wednesday after the man allegedly pointed a replica pellet gun at deputies.
According to a news release from the Sheriff’s Office, a woman reported she was concerned for her safety around 11:55 p.m. Tuesday because 40-year-old Chowchilla resident Andrew Biscay, who she knew, was allegedly in the area of her residence.
The man was described as “having a history of violent behavior and being known to possess weapons,” the news release said.
Deputies arrived at her Los Osos home just after midnight on Wednesday, the agency said. One deputy spoke with the woman as others arrived on scene to search the area and found the man inside his vehicle nearby.
“As deputies made contact, the man, a 40-year-old from Chowchilla, presented a handgun,” the release said. “Both deputies on scene fired their service weapons. The subject was struck and went to the ground.”
An updated new release from the agency said Biscay immediately exited his vehicle when deputies arrived and “took a shooting stance while pointing a handgun.”
Biscay “continued to advance toward deputies resulting in the deputies discharging their service weapons toward Biscay,” despite deputies giving verbal commands,” the release said.
Biscay’s weapon was located immediately near him, the agency said. It was a Beretta PX4 Storm semi-automatic pellet gun, which looks similar to a Beretta PX4 Storm .40 caliber handgun.
A photo from a patrol vehicle’s in-car camera showed Biscay pointing the replica airgun at deputies.
The Sheriff’s Office said deputies called for backup and medical assistance and provided aid until medics arrived at the scene around 12:15 a.m.
No deputies were injured and there is no outstanding suspects or threats to public safety, the release said.
The deputies will be put on administrative leave during the investigation, the agency said, which is in line with standard procedure.
The Sheriff’s Detective Division was investigating the incident and Sheriff Ian Parkinson, as well as other members of the Sheriff’s executive team, responded to the scene.
