SLO County man accused of raping child enters plea after weekend arrest
A San Luis Obispo County man accused of raping a child pleaded not guilty on Wednesday.
The SLO County District Attorney’s Office charged Logan David Morrison, 29, with two felony counts of sexual intercourse and sodomy with a child under 10 years old. Each charge carries a 25 years to life prison sentence.
Morrison was arrested by Atascadero police just before 9 p.m. on Sunday and booked at the SLO County Jail, where he is currently being held without bail, according to Sheriff’s Office booking logs and the Who’s in Custody database.
During his court appearance for his arraignment on the charges Wednesday, he asked to be released from custody, but was denied, according to court records. A protective order was also filed and served in the case, court records show.
Morrison is charged with sexually assaulting a child on two occasions — on Saturday and Sunday — but the DA’s Office intends to admit evidence of prior sexual acts described in the police report and other alleged incidents of abuse under Evidence Code 1108, the complaint said.
California Evidence Code 1108 is a statutory exception that allows prosecutors in sex crime cases to introduce evidence of a defendant’s past and uncharged sexual offenses, which would usually be prohibited as propensity evidence.
The Tribune requested the police report on Morrison’s arrest from the Atascadero Police Department, but was denied due to the ongoing investigation.
Morrison was previously charged with misdemeanor hit-and-run in 2020, to which he pleaded no contest, paid full restitution and served 40 community service hours for, according to court records.
He is scheduled to be back in court June 2 for a bail reduction hearing and again on June 4 for a preliminary hearing.
