8:11 p.m. UPDATE: According to Kolasinski, Mendoza Hernandez is being held at the Stanislaus County Public Safety Center, but The Bee has not been able to confirm that information.

Carlos Ivan Mendoza Hernandez, the man shot by ICE officers last week in Patterson, was discharged from a Modesto hospital just before 1 p.m. Monday and immediately arrested by the Department of Justice. His lawyer said he was initially told he would be taken to the Sacramento County jail for processing. Sacramento County Sheriff's Office confirmed that Mendoza Hernandez is not being detained in any Sacramento County jail.

Until Monday afternoon, Mendoza Hernandez had been in the intensive care unit at Doctors Medical Center, undergoing multiple surgeries for injuries that included seven gunshot wounds.

ICE officials said Mendoza Hernandez used his car as a weapon to attack ICE agents during a traffic stop April 7, an account that his lawyer and a witness dispute.

The FBI had been in the hospital with Mendoza Hernandez and had at times restricted access to him, yet has said he was not in custody, according to his lawyer, Patrick Kolasinski. “He was nowhere near in medical condition to be traveling at all,” Kolasinski said. Mendoza Hernandez’s fiancee, Cindy said he was recovering from his surgeries in the ICU when she visited him on Sunday. On Monday around 10 a.m., she was told by a nurse that he was not in a position to be moved from the ICU. Less than three hours later he was discharged.

“Doctors Medical Center and our physicians make discharge determinations taking into account the unique circumstances of each patient, carefully considering the need for continued inpatient care. Discharge plans are tailored to provide for the safety and continued health journey of the patients. As always, our priority is providing compassionate, quality care for our those who entrust us with their care,” said Patti Turner, a spokesperson for the Doctors Medical Center.

Kolasinski said the Department of Justice is the charging agency.

Mendoza Hernandez is a dual citizen of El Salvador and Mexico and does not have legal status in the United States.

He was acquitted of a murder charge in El Salvador in 2019 and the Department of Homeland Security has not responded to questions about whether he faces other charges in the United States, Mexico or El Salvador.

A spokesperson for ICE said they do not have him in custody.

As of time of publication, the FBI has not stated the charges against Mendoza Hernandez.
