Sentencing for a man convicted of killing an Arroyo Grande teenager was postponed Tuesday, when his attorney announced plans to request a new trial.
Armando Yepez, 21, of Santa Maria was convicted of first-degree murder for the Nov. 17, 2011, drive-by shooting of Gabriel Salgado in Oceano. Salgado, 17, was one of several youths standing on a corner when Yepez drove past and opened fire, hitting Salgado and another teen, who recovered from his injuries.
Yepez, a transplanted gang member from Los Angeles, was angry at Oceano because of confrontations with gang members there, according to court testimony.
During a brief hearing Tuesday, Yepez’s attorney, Gerald Carrasco, announced that he will file a motion for a new trial. Carrasco also requested that Yepez be allowed to have a contact visit with his 1-year-old child. Superior Court Judge Ginger Garrett said she would consider that request after a response from the District Attorney’s Office.
Yepez is scheduled to be sentenced April 30.
