The 27-year-old San Miguel man accused of trying to kill a woman he impregnated faced opening statements in his trial Tuesday morning.

Prosecutor Andy Cadena said Steven Smith shot at Gina Stanko, 35, five times Nov. 6, 2009 because he didn't want to take responsibility for being a father.

Smith lived with another woman at the time - his fiancee - and he had talked her out of leaving him, Cadena said.

In the courtroom, Stanko took the stand and said she and Smith had a physical relationship for six months. Their baby was born six days after the alleged shooting incident.

Smith has pleaded not guilty.
