It seems San Luis Obispo City Councilman John Ashbaugh made a mistake with his ad hominem remark in open session. I note that he has apologized.
Was the remark an unauthorized disclosure of confidential information from the closed session? What if, instead, he had complimented Councilman Dan Carpenter on his incisive closed-session questions?
Are either violations of the Brown Act? While there are civil remedies and criminal sanctions in the act, violations appear to go only to conduct relating to holding or attending closed meetings proscribed by the act.
The City Council has written policies and procedures that include meeting conduct protocol, nondisclosure standards and a censuring process. These seem adequate to address the unfortunate matter without Brown Act hyperbole.
Because I know them both, perhaps I should invite them both over to my patio for a beer.
