A San Luis Obispo Superior Court judge overruled a defense objection to evidence in the ongoing case against a former pop-punk guitarist charged with lewd acts against a child.
During a preliminary hearing Tuesday, Judge John Trice overruled an objection brought by the attorney for Atascadero resident Steven Lee Klein, 34, formerly of the band New Found Glory, ruling that information provided to investigators by Klein’s ex-wife did not violate marital privilege.
In criminal cases, private communications between spouses is privileged information and evidence brought against a defendant based on that information may be suppressed.
Klein faces five counts of lewd acts on a child, one count of contact with intent to commit a sex offense and possession of child pornography. He is accused of engaging in sexual two-way chat room videos involving girls prosecutors allege are between the ages of nine and 16 years old. Klein is not accused of having any physical contact with the alleged victims.
He is scheduled to be back in court on Oct. 14.
