McKinley Ray Thomas, 20, of Los Osos; Eric Ross, 30, of Morro Bay; and Darrell Marquis Switzer, 19, of Bakersfield were discharged after Judge Ginger Garrett ruled Monday that there was insufficient evidence to hold the defendants for charges of burglary, felony false imprisonment with violence, felony battery with serious bodily injury, and misdemeanor battery.
The men were arrested by the Morro Bay Police Department after an alleged burglary at an apartment on the 2100 block of Main Street that took place around 5 a.m. August 18.
It was originally alleged that the suspects held the two residents against their will and battered them, causing injuries.
Cmdr. Bryan Millard of the Morro Bay Police Department declined to comment on the specifics of the investigation, but said there were no independent witnesses to confirm or deny the stories told by the alleged victims and suspects.
“We had probable cause to make an arrest based on investigation, but the decision to go to trial belongs to the judge and the district attorney,” he said.
