Former Oceano General Manager Raffaele Montemurro will receive $12,408, equal to two months' salary plus accrued vacation, according to a settlement agreement approved unanimously by the services district board Friday.
In return, Montemurro agreed not to file a lawsuit or claim against the district.
The board voted unanimously to dismiss Montemurro on May 31 but did not decide whether to dismiss him for good cause, said Molly Thurmond, the board’s attorney.
Thurmond said Friday “there was a lot of discussion” over that point. However, if the board had dismissed him for cause, it was “pretty clear” that legal action would have resulted, she said.
The settlement amount is less than the three months' worth of base salary that Montemurro’s contract stipulated he receive should he be dismissed without cause.
Montemurro was hired in October 2009 as the district's fifth general manager in four years, including two interim managers. He earned $87,500 annually.
