Lowe-Gearhart has agreed to allow the couple’s withdrawal of $60,000 from their retirement plan.
The approved withdrawal is half of what was in the plan since Gearhart filed for bankruptcy protection in Ohio — where he now lives — and $40,000 of that Gearhart has already spent, according to Ken Gibson, an attorney acting on behalf of the trustee.
Normally funds in 401(k) retirement accounts do not become property of a bankruptcy estate, and debtors would be allowed to keep those funds and use them, Gibson said.

Then the calendar changed, and nothing much changed: The sky didn't fall when the new fiscal year started July 1, even though California remained without a balanced budget.
The state's deficit has only grown since then, but the only thing that has come to a standstill are the negotiations over closing California's $26.3 billion deficit.

Pigs Can Fly Aviation, which offers flight training, aircraft rental, charter and maintenance, will soon add aircraft fueling to its mix, making it a full-service fixed-base operator at the San Luis Obispo County Regional Airport.
Fixed-base operators are businesses at an airport that provide fuel, charters and other services.
