Los Osos CSD board member resigns after moving outside district

A Los Osos Community Services District board member has resigned from his position because he recently moved just outside of the district.

David Vogel submitted his written resignation on Dec. 31, saying that he relocated on Dec. 20 and initially didn’t realize he was outside the district boundary — by “about 200 yards,” he estimated.

“When I moved across Los Osos Creek on December 20th, I inadvertently left the Service District and must therefore resign as a director,” Vogel wrote in a letter to board president Leonard Moothart and fellow board members. “It has been a pleasure to work with you and my fellow Directors, as well as staff, our new General Manager, and legal counsel. I leave the District in good hands.”

Vogel, a San Luis Obispo-based attorney, has served on the board for the past three years. His seat is currently vacant.

The district’s legal counsel, Michael W. Seitz, has recommended that the board either appoint a new member to replace Vogel within 45 days of Jan. 2, or wait until the next election in June to fill Vogel’s seat.

“If the Board chooses to appoint Mr. Vogel’s replacement, the Board should provide notice to the elections official and direct the General Manager to publish notice in at least 3 places within the District,” Seitz wrote in his recommendation.

During his term, Vogel said, he and fellow board members worked hard to establish credibility with the county, and he believes they achieved that during his term.
