The sentencing of a man convicted of murder in a Los Osos home-invasion robbery was postponed today after his attorney said he plans to file a motion for a new trial.
Ryan James Johnson was in court today for a scheduled sentencing for his role in a July 2009 robbery gone wrong.
Johnson, 34, was convicted in July by a jury of murder by provocation in the shooting death of 20-year-old Kelsey Alvarez of Templeton one of the conspirators.
Johnson was accused of planning the robbery that was carried out by Alvarez and Jesse Bakerriley.
Bakerriley and Alvarez went to the home of Peter Davis and demanded money and marijuana at gunpoint, according to the evidence presented by Deputy District Attorney Eric Dobroth.
Fearing he would die after being held at gunpoint, Davis grabbed a gun in his home and shot at Bakerriley. One of the bullets struck and killed Alvarez.
Raymond Allen, Johnsons attorney, said he plans to file a motion for a new trial by Jan. 20.
Bakerriley was sentenced in 2011 to 35 years to life in prison for his role in the crime.
