Los Osos developer Jeff Edwards has filed suit to prevent the Board of Supervisors from taking action on the Los Osos wastewater project next Tuesday.
In a press release, Edwards complained that the board intends to modify only one condition of the project at a meeting on that date. The sewer project has dozens of conditions.
If the Board of Supervisors wants to change the project or condition, they should consider the whole project, he wrote.
Edwards is seeking a temporary restraining order. County Counsel Warren Jensen said the county has been served and a hearing will take place Friday morning before Superior Court Judge Teresa Estrada-Mullaney.
The county will oppose the application for TRO and will probably be filing a written opposition Wednesday afternoon or Thursday morning, Jensen wrote in an e-mail to The Tribune.
At this point, suffice it to say that we believe there is no merit to Mr. Edwards' lawsuit or to his application for TRO, Jensen wrote.
